Our Warranty Statement to You
We pride ourselves on the ability to provide personalized service and attention to detail on the service that we provide. It is with this confidence that we provide the following Warranty Statement as our personal quality promise to our clients.
Subject to the exclusions set forth below, Tie National, LLC (TIE) provides the following limited warranties.
TIE warrants that its installation shall be free from defects in workmanship in connection with such installation for a period of ninety (90) days after the cut-over date (defined in the purchase agreement between TIE and purchaser as the date on which TIE executes or otherwise completes a “Closure of Installation Ticket”). The standard of workmanship shall be the industry standards required by the Institute of Electrical and Electronics Engineers (IEEE) and applicable federal, state, or local codes.
TIE warrants that its equipment will be free from manufacturer defects under normal use by purchaser for a period of one (1) year after the cut-over date. Within this period the equipment will be replaced via Advanced Replacement, where a replacement piece of equipment will be shipped and the old defective equipment will be required to be returned.
LABOR – The warranty on Equipment covers labor costs in connection with troubleshooting and replacing any defective equipment for a period of ninety (90) days after the cut-over date.
EMERGENCY DISPATCH – The warranty of equipment covers the emergency dispatch of one or more technicians (at TIE’s sole discretion) only for a “Service Affecting Issue.” A “Service Affecting Issue” means a defect in Equipment that causes an outage in which 50% or more of the voice and\or data functionality is unusable, as determined by TIE, and TIE determines that the outage cannot be fixed remotely.
SHIPPING – If TIE determines that parts must be shipped to Purchaser in connection with a defect in the Equipment, then TIE shall ship such parts to Purchaser using ground services for defects that do not cause a Service Affecting Issue, and using overnight mail service for defects that cause a Service Affecting Issue. Shipping of defective equipment back to Tie National will be the responsibility of the Purchaser.
STRUCTURED CABLING MATERIAL
TIE warrants that structured cabling material that is certified by TIE will be free from defects and satisfy TIA/ISO certification standards under normal use by purchaser for a period of twenty (20) years after the cut-over date.
LABOR – The warranty on structured cabling material shall cover labor costs in connection with troubleshooting and replacing any defective structured cabling material for a period of ninety (90) days after the cut-over date.
COMPUTERS HARDWARE – Computer Hardware purchased through TIE are warrantied though the manufacturer. TIE will coordinate the warranty if it is engaged within 90 days of the purchase date. A list of items that constitute Computer Hardware include but are not limited to: Computers, Servers, Monitors, Keyboards, Mice, etc.
PAYMENT TERMINALS – Advance replacement for payment terminals are subject to a different process than normal equipment. Since key injection is required it may be charged even though the hardware is warrantied for 1 year from the manufacturer. Charges may apply for advance replacement options.
NONPAYMENT – This Limited Warranty shall not be effective, and TIE shall not be required to honor the Limited Warranty, with respect to any defects in the Equipment or in the installation of the Equipment that occur during at any time in which any amount owed by Purchaser under Purchase Agreement is past due. The term of this Limited Warranty shall not be extended for any period in which the Limited Warranty is not effective.
NORMAL WEAR AND TEAR – Periodic maintenance, repair and replacement of parts due to normal wear and tear are excluded from coverage under this Limited Warranty.
ABUSE AND MISUSE – Defects in or damage to the Equipment resulting from the following are excluded from coverage under this Limited Warranty:
(i) failure of Purchaser to provide a suitable and proper operating environment for the Equipment as required by all applicable manufacturer specifications and industry standards for the Equipment, including, without limitation, furnishing all necessary commercial power as required; raceways; electrical and telecommunications connections; and environmentally controlled areas for the central Equipment with appropriate air temperature, humidity, ventilation, and which is free from dust and smoke, continuously 24 hours per day;
(ii) improper operation, storage, misuse or abuse, accident, neglect of the Equipment, or other failure of Purchaser to comply with current IEEE standards or manufacturer specifications for the maintenance of the Equipment;
(iii) contact with liquid, water, rain, extreme humidity, heavy perspiration, sand, dirt, extreme heat, or food particles; and
(iv) any acts of God, terrorism, fire, theft, accident, or any cause beyond the reasonable control of TIE.
ALTERATIONS – Defects in or damage to the Equipment resulting from alterations to the Equipment by any party other than TIE are excluded from coverage under this Limited Warranty.
USE OF NON-TIE EQUIPMENT – Defects or damage in Equipment resulting from the use of other peripheral equipment not installed by TIE are excluded from coverage under this Limited Warranty.
EXCLUSIVE REMEDY – This limited warranty is Purchaser’s exclusive remedy for any action that causes a breach of a warranty set forth herein.
